Welcome to understandmyfertility.com. The fertifacts™ website and associated digital products are operated by our company. By accessing the website, taking the quiz, or purchasing the fertifacts™ research summary, you agree to these terms. If you do not agree, please do not use the service.

What fertifacts™ is (and what it is not)

fertifacts™ is a general-information research summary based on publicly available peer-reviewed studies, national registry data, and fertility society guidelines. It shows population-level statistics for age brackets and commonly cited lifestyle factors.

fertifacts™ is not a medical device, diagnostic tool, prognostic tool, or substitute for personalized medical assessment. It does not create a doctor-patient relationship. It does not replace consultation with a reproductive endocrinologist, OB-GYN, or other licensed clinician.

Eligibility

You represent that you are at least 18 years old, reside in a country where this service is lawfully offered, and are using the service for personal, non-commercial purposes only.

The product

For a one-time payment of currently $49, you receive an instantly generated PDF research summary (the "report") based on the general inputs you provide during the quiz. The report references peer-reviewed studies, registry data, and published guidelines. It is delivered via a download link and sent to the email address you provide.

No medical, legal, or financial advice

Nothing in the report or on the website constitutes medical advice, diagnosis, treatment recommendation, prognosis, or clinical interpretation of your individual health. Statistics shown are population-level aggregates and may not reflect your personal situation. Do not act, or refrain from acting, on the basis of content in the report without seeking advice from a qualified licensed professional.

No guarantee of outcomes

We make no representation, warranty, or guarantee that following any information in the report will result in pregnancy, successful In Vitro Fertilization (IVF), successful egg freezing, or any other outcome. Fertility is influenced by many factors outside any statistical model.

Refund policy

We offer a full refund within 7 days of purchase, no questions asked. To request a refund, email hello@drmaxmulke.com from the email address used for purchase.

Intellectual property

The website, quiz, report format, branding (including fertifacts™), copy, and underlying models are owned by us or our licensors. The report you receive is licensed for your personal, non-commercial use only. You may not resell, redistribute, republish, or create derivative works without our prior written permission.

Acceptable use

You agree not to reverse-engineer the quiz, tamper with the site, submit false information to obtain a refund fraudulently, use automated tools to scrape content, or use the service in any way that violates applicable law.

Payments

Payments are processed by Stripe and/or PayPal. We do not store your full payment card details. You authorize the applicable payment processor to charge the amount shown at checkout.

Disclaimer of warranties

The website and report are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, in no event shall we, our officers, directors, employees, affiliates, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, lost data, personal injury, emotional distress, or damages arising from any reliance on information in the report. Our total aggregate liability to you for any and all claims arising out of or relating to these terms or the service shall not exceed the amount you actually paid us in the twelve months preceding the event giving rise to the claim (currently capped at $49).

Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your breach of these terms or your misuse of the service.

Governing law and dispute resolution

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any dispute arising from or relating to the service or these terms shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Delaware. You waive any right to participate in a class action or class arbitration. You may opt out of arbitration within 30 days of first accepting these terms by emailing hello@drmaxmulke.com with the subject line "Arbitration opt-out".

Changes to these terms

We may update these terms from time to time. The "last updated" date at the top will change. Continued use of the service after an update means you accept the updated terms.
